Introduction Welcome to Sherwah.com. These Terms and Conditions govern the use of our website and the sale of goods by the Sherwah Group (including Sherwah Farm, Sherwah Enterprises, and Sherwah Global). By placing an order or requesting a quote through this website, you agree to be bound by these terms.
1. Nature of Goods Our business operates on a hybrid model serving both commercial entities and individual consumers. It is important to distinguish the nature of the goods being purchased:
- Bulk Commodities & Export (B2B): Includes Field Crops (Wheat, Cotton, Sugarcane, Mustard), bulk Onions, and Aseel Dates. These items are sold exclusively to mills, wholesalers, and international importers. We do not sell Dates in small retail quantities.
- Retail & Consumer Goods (B2C): Includes seasonal Fresh Fruit (specifically Sindhri Mangoes) and Imported Coffee. These are available for direct purchase by households and individual consumers.
2. Pricing & Validity Agriculture is a dynamic industry dependent on market rates and harvest conditions.
- Fluctuating Prices: Prices for all products—including Retail Goods—are subject to change without prior notice based on market fluctuations, seasonal availability, and exchange rates.
- Quotations: Using the “Request Quote” feature on our website represents an inquiry, not a binding contract. A sale is only confirmed once a formal Invoice or Sales Contract is issued by Sherwah and accepted by the buyer.
3. Payment Terms
- Retail Orders: We operate on a strict 100% Advance Payment policy. Orders will only be processed or harvested once full payment is verified. We do not offer Cash on Delivery (COD).
- Wholesale/Export Contracts: Payment terms are defined in the individual commercial invoices or contracts agreed upon before loading.
4. Shipping & Delivery
- Retail (Fresh Produce): We utilize third-party logistics and courier services to deliver fresh fruit and coffee. While we package goods with the utmost care to withstand transit, delivery timelines are estimates provided by the courier company.
- Bulk/Wholesale: Unless otherwise explicitly agreed in writing, all bulk commodity sales are Ex-Farm (Deh 136/137, Taluka Sindhri). The buyer is responsible for arranging transport and insurance once the goods leave our weighbridge.
5. Fresh Produce Policy (Refunds & Complaints) We take immense pride in the quality of our harvest. However, dealing with perishable goods (such as Mangoes) requires strict policies to prevent abuse.
A. Non-Returnable Due to the perishable nature of fresh produce, we do not accept returns.
B. Damage Claims If your shipment arrives significantly damaged or spoiled, we offer a resolution under the following strict conditions:
- Reporting Window: The issue must be reported to our WhatsApp support or Email within 24 hours of delivery. Claims made after 24 hours will not be entertained.
- Evidence Required: You must provide clear Photographic AND Video evidence of the damaged goods immediately upon opening the package.
- Resolution:
- If the claim is validated, we will process a Cash Refund for the affected quantity.
- A Replacement Shipment may be offered at our sole discretion, strictly subject to the availability of remaining stock during the season.
C. Natural Variation Farm produce is a natural product. Slight variations in size, color, or skin blemishes that do not affect the quality of the pulp/consumption are not grounds for a refund.
6. International Trade (Exports) For the export of commodities such as Dates, Onions, and bulk Mangoes, all terms regarding Incoterms (FOB/CIF), Phytosanitary Certificates, grading standards, and Customs duties will be governed by the specific Export Contract signed between Sherwah Global and the foreign buyer.
7. Governing Law These terms shall be governed by the laws of Pakistan. Any disputes arising from the use of this website or the sale of goods shall be subject to the exclusive jurisdiction of the courts in District Mirpur Khas, Sindh.
